Welcome to Ardessa. This website ("www.ardessa.com.au") is owned and operated by Ardessa. Throughout the Site, the terms “we”, “us” and “our” refer to Ardessa. By visiting our Site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

1. ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

2. PRODUCT CHARACTERISTICS & VARIATIONS (NATURAL STONE)

Ardessa specializes in natural stone products, including but not limited to Calacatta Viola, Elba Livio, Nero Marquina, and White Onyx.

Natural Variation: You acknowledge that stone is a natural material. Variations in color, veining, texture, and pattern are inherent characteristics and are not considered defects.
Unique Attributes: No two pieces are identical. While we strive to represent products accurately through photography, the item delivered may differ from the digital representation.
Hand-Finishing: Many of our products feature hand-finished details (such as sharknose edges). Minor artisanal irregularities are part of the product’s character.

3. ACCURACY OF PRICING AND BILLING

Price Changes: Prices for our products are subject to change without notice.
Modifications: We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice.
Errors: In the event that a product is listed at an incorrect price due to a typographical error or error in pricing information, we reserve the right to refuse or cancel any orders placed for products listed at the incorrect price.

4. SHIPPING AND DELIVERY

Weight & Fragility: Due to the weight and fragile nature of stone, we utilize specialized couriers for certain items.
Title and Risk: The risk of loss and title for all merchandise ordered on this Site passes to you when the merchandise is delivered to the shipping carrier.
Inspection: Upon delivery, you are responsible for inspecting the item immediately. Any damage must be reported within 48 hours as per our Return Policy.

5. INTELLECTUAL PROPERTY

All content included on this Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations, is the property of Ardessa or its content suppliers and is protected by international copyright laws. You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission from us.

6. PROHIBITED USES

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others.

7. LIMITATION OF LIABILITY

Ardessa shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Ardessa has been advised of the possibility of such damages.

Stone Care: Ardessa is not liable for damage caused by improper care, including staining from acidic liquids, heat damage, or the use of abrasive cleaners on porous stone surfaces.

8. AUSTRALIAN CONSUMER LAW

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

To cancel your service contract with us; and
To a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time.

9. GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to conflict of law principles.
